Los Angeles County Personal Injury Lawyer
Personal injury is a wide category that covers a lot of different kinds of infractions. The common denominator amongst all types of personal injury cases is that the negligence of one party— be it an individual, a group of people, or a company— caused an injury to another. When that happens, the victim is entitled to get compensation from the insurance company of the party responsible for the accident. The victim will need that compensation to cover the expenses caused by the accident, such as medical expenses, repair or replacement bills for lost property, and lost wages. If the victim wants the best chance of getting that compensation, then they will need to contact a personal injury lawyer.
And if someone needs a personal injury attorney in Los Angeles County, then they should contact us at Timothy J. Ryan & Associates. We have been helping residents of Los Angeles with their personal injury cases for nearly forty years. That means we have the knowledge, experience, and expertise needed to give our clients the best chance of getting the compensation that they need. So if you were unfortunate enough to have suffered a personal injury in Los Angeles, then please get in touch with us as soon as you can so that we can give you a free case evaluation and then get to work on your case.
The Elements of a Personal Injury Case
As stated in the introduction, negligence is the main factor in the majority of personal injury cases. However, there are other factors as well, and they are as follows:
- The defendant (the party that caused the accident) owed the plaintiff ( the victim of the accident) a duty of care. A duty of care means that a person should behave in the way a reasonable person would in a similar situation. For example, a driver should follow the rules of the road and pay attention while they are driving because they owe it to everyone on the road to be a safe and attentive driver.
- The duty of care was breached. This is where negligence comes in because that is essentially what a breach of duty is. That means a person was behaving in a way that is reckless, careless or disregards the safety of others. In the example with the driver, it would mean that they could be engaging in unsafe behavior such as texting while driving instead of paying attention to the road.
- The negligence led to an accident. While a breach of duty is bad by itself, it is necessary for that breach to actually cause an accident. So a driver who was not paying attention is negligent, but they have to cause an accident for their negligence to be considered a personal injury.
- The accident caused losses for the victim. Those losses could be anything from medical bills if the victim got injured, repair bills if their property was damaged, or lost wages if their injuries prevent them from working.
Types of Personal Injury Cases
There are a lot of different situations that count as personal injuries because the elements of a personal injury case are so broad and inclusive. The following are some of the types of cases that we will take on at Timothy J. Ryan & Associates:
Car Accidents – These are very common occurrences on the roads of Los Angeles. Some of them are relatively mild, with little damage to the vehicles and their occupants. However, some can be very dangerous and can put drivers and passengers in life-threatening situations.
Truck Accidents – The large size and weight of trucks compared to other vehicles means that a truck accident could cause an immense amount of damage to other vehicles and their occupants.
Bus Accidents – Buses are also bigger and heavier than other vehicles, which means that accidents involving buses can also be very devastating to other vehicles.
Motorcycle Accidents – Motorcycle riders do not have much protection besides a helmet, which means that they are especially vulnerable to getting serious injuries if they get into an accident with another vehicle.
Medical Malpractice – There are some cases where a healthcare provider will accidentally hurt their patient instead of helping them. For example, in cases involving misdiagnosis, surgical errors, poor aftercare, and more.
Defective Products – There are situations where a defect can cause a product to injure someone even if they were using the product in the way that it was intended. That defect could occur in the design phase, the manufacturing phase, or the distribution phase of the product. A personal injury lawyer is useful in these cases because they can identify which party was responsible for the defect.
Premises Liability – This is when someone who was legally on another person’s property gets injured because of a dangerous condition on that person’s property. A common example is a slip and fall in a store because the owner did not clean up a spill in time, but a premises liability case can happen on commercial or residential property.
Wrongful Death – When someone dies from the injuries they suffered in a personal injury, then it becomes a wrongful death case. In these cases, the family of the deceased is entitled to receive compensation to cover the losses caused by the loss of their family member.
